Workers Compensation:
Regular members of volunteer and municipal or county fire departments, either without pay or with full pay on a part-time basis, are deemed to be employees. However, the basis of computing wages for premium payments and compensation benefits shall be equal to the beginning salary of the same rank or grade in the full-time service within the area.

Benefit for spouse with no children is 2/3 of average monthly wage of firefighter until death or remarriage; for spouse with children, 35% until death or remarriage. Remarriage terminates spousal benefit but it can be reinstated for a remarried spouse who becomes single again. Spouse receives two years' compensation in one lump sum upon remarriage. Children receive 31 2/3% of average monthly wage divided among them equally until age 18 or married, longer if disabled and incapable of self-support and until age 22 if full-time student. Law specifies rules for compensation in other situations, including recent changes in presumption that firefighter deaths and disabilities from certain cancers are the result of occupation and employment. Law also specifies that any firefighter injured or killed while traveling to or from work shall be considered in the course and scope of employment solely for the purposes of eligibility for workers' compensation benefits.

Funeral:
Maximum benefit of $5,000 for burial expenses.

Pension:
Spouse of Public Safety Retirement System member receives 100% of the deceased member's monthly average monthly benefit compensation. Children are eligible for benefits until age 23 if they are full-time students and unmarried. The pension plan is reinstated for remarried spouses who become single again.

Child's Education:
The benefit is a full tuition waiver at state universities or community colleges for children age 30 or younger. This benefit covers deaths of firefighters traveling to or from work. It is limited to 64 credit hours at community colleges and a total of credits, including transfer credits, needed for a baccalaureate degree. For graduate study, 80% of tuition is covered.

Malpractice By state statute, a trained responder is not subject to civil liability for any personal injury that results from any act or omission, except in cases of willful misconduct or gross negligence.

Additionally, any donor of firefighting equipment shall not be subject to criminal or civil liability arising from a death or injury due to the equipment donated as long as it is fit for use at the time of donation.

 

Retirement Local municipalities may choose to offer a pension plan under state statute. The benefit is $200 per month at 20 years of service and age 60 or at 25 years of service. Two percent insurance premium tax proceeds are added to volunteer retirement pension fund.
